Your personal data will be processed by Monte Garcia Nunes, Lda., registration number 517077752, with its registered office at Rua João Compadre, 19, 2100-039 Coruche, Portugal, hereinafter referred to as Monte Garcia Nunes.

Monte Garcia Nunes acts as the Data Controller in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation – GDPR).

What purposes do we process your personal data for?

Your personal data may be collected and processed by Monte Garcia Nunes for the following purposes:

a) Compliance with legal obligations: To comply with legal obligations applicable to Monte Garcia Nunes, including mandatory reporting to the Agency for Integration, Migration and Asylum (AIMA) or the competent border control authority, as well as for invoicing and tax compliance purposes.

b) Performance of the accommodation contract: Or the accommodation management agreement entered into with Monte Garcia Nunes, including payment processing, check-in and check-out management, guest management, security deposit collection, as well as the provision of additional services related to your stay (such as housekeeping, transfers, breakfast or grocery services) and pre-contractual procedures.

c) Marketing and informational communications: To send commercial communications by email, SMS or other electronic means as part of Monte Garcia Nunes' marketing activities, as well as to respond to information requests.

d) Property protection and statistical analysis: To protect the property and assets of Monte Garcia Nunes and to carry out internal statistical analysis.

Notice: Failure to provide the personal data required for the purposes described in points (a) and (b) will prevent Monte Garcia Nunes from fulfilling its legal and contractual obligations, making it impossible to enter into or maintain the accommodation contract, without giving rise to any right to compensation.

What personal data do we collect and how long do we keep it?

Data collected: As part of its activities, Monte Garcia Nunes will collect and process the personal data necessary for the provision of the contracted services or pre-contractual management, including identification data (name, identity card or passport), contact details (telephone number and email address), and bank account or payment card details.

Retention period: Without prejudice to any legal, regulatory or judicial requirements, the personal data collected will only be retained for the minimum period necessary to fulfil the purposes for which it was collected or subsequently processed.

What is the legal basis for processing your personal data?

The processing of your personal data is based on the following legal grounds under Article 6(1) of the GDPR:

  • Performance of a contract and compliance with legal obligations (Articles 6(1)(b) and 6(1)(c)): Applicable to the management of bookings, stays, invoicing and the reporting of foreign guests to the competent authorities.
  • Consent (Article 6(1)(a)): Applicable to marketing communications and newsletters, subject to the customer's explicit consent.
  • Legitimate interests (Article 6(1)(f)): Applicable to protecting the property and carrying out statistical analysis.

Who may we share your personal data with?

Monte Garcia Nunes may need to share your personal data with:

  • Public authorities to whom it is legally required to provide information (e.g. the Portuguese Tax and Customs Authority, law enforcement agencies or the competent border control authorities).
  • Data processors providing technical support, website and system hosting, email marketing services, cleaning services, accounting firms, legal advisers and insurance companies.
  • Competent authorities in the event of legal proceedings or security audits.

International transfers: Personal data is primarily processed within the European Union. Should it become necessary to transfer data outside the EU (for example, for cloud storage or backup purposes), Monte Garcia Nunes guarantees that such transfers will only take place to countries ensuring an adequate level of data protection and in full compliance with the GDPR.

What are your rights?

At any time, in accordance with the GDPR, you may request:

  • Access to, rectification or erasure ("right to be forgotten") of your personal data.
  • Restriction of processing or the right to object.
  • Data portability.
  • Withdrawal of your consent for marketing purposes, without affecting the lawfulness of processing carried out before such withdrawal.

If requests are manifestly unfounded or excessive (for example, repetitive requests), Monte Garcia Nunes reserves the right to charge a reasonable administrative fee or refuse to act on the request.
